Defamation can’t be an opinion and it can’t be related to a charge for which Kyle was tried. Actual malice is only in the case where the person was lying and knew he was lying. So there is no actual malice because Joe Biden had no idea what he was talking about. And Kyle is going to have to be able to prove damages unless he just wants a piece of paper for his wall that says yes you were defamed, but you have suffered no damages.
