Don’t Expect Senate Marijuana Banking Vote Any Time Soon, Key Chairman Says

“This committee’s been too much about Wall Street and not enough about housing, not enough about rural and urban affairs and people’s everyday economic lives, and that’s my focus,” Brown said. “I will look at this seriously. We’re not ready to move on it.”

That said, he didn’t provide details in his latest comments about what particular reforms he’d want to include, saying “I’m not a lawyer and I want to understand that part better and make sure we do it right.”

“We’ll probably get one good shot at this and I want to do it right,” he said.

Perlmutter, meanwhile, says he’s open to doing what it takes to get the bill approved this Congress, and he told KOA News Radio that while he’s been “overly optimistic” in the past, he’s confident the SAFE Banking Act will pass this session.

Florida Supreme Court Kills 2022 Marijuana Legalization Initiative That Hundreds Of Thousands Had Signed

At issue, the majority justices said in their ruling, is the use of the word “permits” in the ballot summary when referring to activities such as possessing and purchasing marijuana by adults 21 and older. Because the initiative fails to acknowledge that such activity would not be permissible under federal law, they deemed the summary “misleading” and therefore unconstitutional.

“The summary’s unqualified use of the word “[p]ermits” strongly suggests that the conduct to be authorized by the amendment will be free of any criminal or civil penalty in Florida… The proposed amendment, on the other hand, explains that the conduct will only be free of criminal or civil liability “under Florida law.” The proposed amendment includes that language, of course, because a recreational marijuana user or distributor will remain exposed to potential prosecution under federal law—no small matter.”

But in a dissenting opinion, two justices argued that it’s essentially self-evident that the measure would only apply to Florida law and not change federal statute prohibiting marijuana.

Proposed CBD law in Illinois draws ‘major concerns’

Under the measure, the Illinois Department of Public Health, the Illinois State Police, sheriff’s departments, municipal police and the Illinois Department of Revenue would be authorized to inspect CBD manufacturers and distributors to assure they are in compliance with state rules.

Both the Midwest Hemp Coalition and Illinois Hemp Growers Association have said they support efforts aimed at product safety, but said the bill as drafted is not feasible.

## Conflict charged

Some stakeholders suggested Morgan, who has received campaign donations from marijuana interests, is looking to give that side of the cannabis industry an advantage.

The lawmaker has received a total of $30,700 from 14 companies involved with marijuana sales and research since 2017, according to campaign finance records.

Morgan denied the proposed bill has advantages the marijuana industry. “This is really pretty purely a public safety issue,” Morgan told Chicago-based DailyHerald.com. “Any industry group or business out there that is not willing to make their products safe before selling them to someone for ingesting, then we will have to disagree. … I make no apologies for passing legislation that makes products safer.”
